These Terms and Conditions (the “Terms”) govern your access to and use of the website located at rexqu.com (the “Site”) and your purchase of any products from REXQU Smartwatches (“REXQU,” “we,” “us,” or “our”). By accessing the Site, creating an order, or purchasing a product, you agree to be bound by these Terms and by our Privacy Policy, Disclaimer, and Returns & Refund Policy, which are incorporated by reference. If you do not agree, please do not use the Site or purchase our products.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract to purchase from us. By placing an order you represent that you meet these requirements and that the information you provide is accurate and complete.
2. Products, Descriptions & Availability
We sell wellness-oriented smartwatches and related accessories. We work to describe and display our products accurately, but we do not warrant that product descriptions, images, colours, specifications, or other content are error-free, complete, or current. Actual products may vary slightly from images. All products are subject to availability, and we may limit quantities, discontinue any product, or correct errors at any time without liability.
3. Pricing & Payment
Prices are listed in U.S. dollars (USD) unless stated otherwise and are exclusive of any taxes, duties, or shipping unless indicated at checkout. Payments are processed securely by our third-party payment processor, Stripe; we do not store your full card details. You represent that you are authorised to use the payment method provided. If a price or promotion is listed in error, we reserve the right to cancel or refuse any order placed at the incorrect price, even after an order has been confirmed.
4. Orders & Order Acceptance
Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and a confirmation email acknowledges receipt of your order but does not by itself constitute acceptance. We may refuse, cancel, or limit any order at our discretion, including where we suspect fraud, an unauthorised transaction, or an error in pricing or product information. Where the checkout offers optional add-on or one-click upsell items after your initial purchase, each such item is a separate, clearly-priced offer that is only charged if you affirmatively accept it.
5. Shipping & Delivery
We aim to process orders within 24–48 hours and offer tracked shipping as described at checkout and on our product pages. Delivery time frames are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier or to you, as applicable. You are responsible for providing an accurate shipping address and for any import taxes, customs duties, or fees that may apply in your destination country.
6. Returns, Refunds & Cancellations
Eligible products may be returned in accordance with our Returns & Refund Policy, which generally provides a 30-day money-back guarantee subject to the conditions set out in that policy. 7. Health & Wellness Disclaimer
REXQU products are consumer wellness and fitness devices intended for general lifestyle and informational purposes only. They are not medical devices and are not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition. Readings and data (including heart rate, blood oxygen, ECG-style, sleep, and related metrics) are estimates for personal reference and may not be accurate. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any questions about a medical condition, and never disregard or delay seeking professional advice because of information provided by a REXQU product. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
8. Intellectual Property
The Site and its content—including text, graphics, logos, images, product designs, and software—are owned by or licensed to REXQU and are protected by intellectual-property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission.
9. Acceptable Use
You agree not to use the Site or our products to: violate any law or regulation; infringe the rights of others; submit false or fraudulent information; introduce malware or attempt to gain unauthorised access to our systems; or interfere with the operation or security of the Site. We may suspend or terminate access for any misuse.
10. Third-Party Services & Links
The Site relies on and may link to third-party services (such as Stripe for payments) and websites that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of those services is subject to their own terms and privacy policies.
11. Disclaimer of Warranties
Except for any express manufacturer or limited product warranty that we specifically provide in writing, the Site and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all other warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, REXQU and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Site or products. Our total aggregate liability for any claim arising out of or relating to these Terms or a product will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless REXQU and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or products, or your violation of any law or the rights of a third party.

15. Changes to These Terms

16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that the courts located in the Province of Ontario, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Site, subject to any non-waivable rights you may have as a consumer under the laws of your place of residence.
17. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the policies referenced above, constitute the entire agreement between you and REXQU regarding the Site and your purchases.

Watch faces, screen layouts, readings and any data shown on a device display are illustrative examples — they are not actual measurements, and they do not represent results you should expect from your own device.
Actual product appearance may vary. Display colours, watch face designs, packaging, straps and included accessories can differ depending on the model, colourway, firmware version and production batch, and colours may render differently from one screen to another. Where a REXQU-designed watch face is shown, it may be supplied pre-installed or as a free download through the companion app, depending on your model.
